Arbitration in private equity

We had a pleasure to participate in a Seminar on Arbitration in Private Equity organized by Polish Private Equity and Venture Capital Association (PSIK) in cooperation with Invest Europe. Michał Karwacki, head of PE/VC supported our client Resource Partners, represented by Małgorzata Bobrowska-Jarząbek, acting as a respondent in a pre-closing dispute.
The aim of the seminar was to highlight arbitration issues in private equity transactions, and get private equity practitioners educated about and acquainted with the spirit and practice of arbitration and how it differs from court proceedings. The seminar focused on two cases involving a pre-closing and a post-closing dispute. Private equity professionals and their M&A transaction lawyers acted as claimants and respondents in each case, which was presided over by an arbitration judge. The cases highlighted real life issues that are relevant to typical transaction work of private equity firms.
